LIMITED WARRANTY
The Company warrants that it will render the services hereunder in a good and workmanlike manner. As the Company’s sole responsibility and the Customer’s exclusive remedy in the event of any material failure to meet such standard, the Company shall make a reasonable effort to remedy any resulting discrepancies. Any claim based on the foregoing warranty must be submitted in writing in accordance with the Company’s standard procedures within thirty (30) days after delivery or the date of the required delivery of the pertinent services at issue.

EXCEPT AS EXPRESSLY SET FORTH IN THIS PARAGRAPH, THE COMPANY MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION, THE COVERED SERVICES. THE COMPANY SPECIFICALLY DISCLAIMS, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE.

LIMITATION OF LIABILITY

The total liability of the Company (including its employees, agents, subcontractors and suppliers) for all claims, whether in contract, tort (including negligence, product liability and strict liability), or otherwise, arising out of, connected with, or resulting from any performance or on performance hereunder shall not exceed the lesser of the total fees paid by the Customer to the Company allocable to the services that give rise to the claim, or the cost of the Software as reflected on the Purchase Order. In no event shall the Company be liable for any incidental, consequential, indirect, or special damages (including, without limitation, damages for loss of revenue, cost of capital, claims of customers for service interruptions or failure of supply, and costs and expenses incurred in connection with labour, overhead, transportation, installation, or removal of equipment or programming or substitute facilities or supply sources), even if the Company has been advised of the possibility of such damages.

PRIVACY
You should also be aware that we may occasionally provide links from our Web site to other sites that we think will interest you. If you click on a banner advertisement or any other link, the "click" will take you off the FinSolve site. Once you leave the FinSolve Web site, any information that you may have provided remains with us and is not forwarded to the next site to which you have linked. Finsolve have built their ecommerce solution according to specifications provided by Iveri. Credit card details captured on the Finsolve Payment page are submitted to Iveri using 128 bit encryption. The Finsolve ecommerce solution does not store or view any of the credit card payments taken on the website. The security of credit card details over the web have improved significantly over the past few years. While FinSolve believe online payments are more secure than traditional physical credit card payments, it cannot be held responsible for credit card fraud on cards that have been used on this website.
